Bhubaneshwar: The Naveen Patnaik-led Odisha government on Monday ordered a blanket ban on firecrackers other than Green crakers. In order, the government stated, “only ‘green fireworks’ are allowed for sale and use, imposed a complete ban on other firecrackers.”
Earlier today, the Supreme Court set aside the order of the Calcutta High Court which imposed a complete ban of use of firecrackers in the State of West Bengal. “…we are convinced that Calcutta High Court should have called upon parties to give explanation before passing such an extreme order”, the Court observed in the order.
The top court further added that the order applies uniformly to all States and West Bengal cannot be an exception. “This is not a new issue. The Supreme Court has already passed order. It has to be implemented uniformly,” the apex court said.
Why Calcutta High Court Imposed Complete Ban on Firecrackers?
The Calcutta High Court had imposed a blanket ban on firecrackers on the ground that it would be practically impossible for the executive to identify and take action against violators since no mechanism was in place to distinguish green crackers and it would create an impossible task for law enforcement agencies.
